How to treat a whole life prisoner in Ukraine?

We have achieved an official court decision: the prisoner has the right to choose and sign a declaration with the family doctor.

Friends and colleagues, we are in a hurry to share another successful case, which, we hope, will become a legal precedent, as well as a formula for success for people who find themselves in a similar situation.

And just now we are telling how, with the help of the initiative and willpower of one person who decided to fight for his rights, as well as competent legal support for this case by UnMode specialists, we managed to defend the right of a person to a family doctor in court!

“In October, Roman (name changed), serving a life sentence, asked me to help start treatment for viral hepatitis C. At that time, the man was in the Rivne Detention Center, where he, along with other prisoners, was evacuated from Bakhmut . There, in Bakhmut, where the heaviest battles of the Armed Forces of Ukraine against the Russian army are now being fought, his family doctor remained,” says Yanina Stemkovskaya, a representative of UnMode in Ukraine.

Roman tried to get treatment on his own, but only a paramedic was among the medical workers in the pre-trial detention center.

“A whole life term prisoner has two options: seek treatment on the basis of civil medicine institutions or receive treatment according to the prescription of a paramedic, which is obviously a losing option, often on the basis of a medical unit, all diseases are treated with one medicine. We held a series of consultations, and Roman independently wrote and sent a request from the pre-trial detention center to the Public Health Center of the State Penitentiary Service of Ukraine and to a number of other state institutions, ”continues Yanina Stemkovskaya.

The first victory was that thanks to the efforts of Romana and the coordination of Janina Stemkovskaya, the man began to receive free treatment for hepatitis.

And the countdown point in this case was the official response of the Public Health Center of the State Penitentiary Service of Ukraine, which stated that on the basis of penitentiary institutions, a prisoner cannot conclude an agreement with a family doctor.

UnMode comments: according to the current medical system in Ukraine, free consultations of narrow specialists or redirection for tests can be carried out only with a referral from a family doctor, with whom every adult Ukrainian must have a declaration.

With an appeal against the response of the Public Health Center of the State Penitentiary Service of Ukraine, Roman appealed to the Rivne city court and on December 20 the court decided: the right to choose a family doctor and sign a declaration with him is undeniable!

We are attaching a copy of the court decision with Roman's permission, but for security reasons we keep his personal details confidential.

We are incredibly proud of how quickly and successfully the initiative and knowledge of the laws worked!

“For me, this is a situation confirming the fact that if a person is ready to fight for his rights, absolutely nothing is impossible for him», says Yanina Stemkovskaya.
